1. Acceptance of Terms

By accessing or using CareAutopilot ("the Platform"), located at careautopilot.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

2. Description of Service

CareAutopilot is a marketing, recruitment, and growth platform for home care agencies. Our services include:

• AI-powered content generation (social media posts, blog articles, ad copy).
• Competitive intelligence tools (wage lookup, competitor scanning, ad library browsing).
• Caregiver recruitment campaigns with landing pages and lead capture.
• Advertising campaign management on Meta (Facebook/Instagram) and Google.
• Lead delivery from landing page forms and Meta Lead Ads.
• Free tools including Google Business Profile audits and email-gated resources.

3. Accounts and Registration

To access paid features, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Subscription Plans and Payment

• Free tier: access to free tools (wage lookup, competitor scanner, GBP audit) with no subscription required.
• Paid plans: Intel, Growth, and Platform tiers with additional features. Pricing is displayed at checkout.
• Payments are processed securely by Stripe. By subscribing, you authorize recurring charges at your selected billing interval.
• You may cancel at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods.
• Promotional codes and discounts are subject to specific terms at the time of offer.

5. Advertising Campaign Services

When you use CareAutopilot to create and deploy advertising campaigns on Meta or Google:

• You authorize us to create, manage, and modify ad campaigns on your behalf using your connected ad accounts.
• Ad spend is billed directly by Meta or Google to your linked ad account, not by CareAutopilot.
• We create campaigns in compliance with platform advertising policies, including Meta's Special Ad Category requirements for employment ads.
• We do not guarantee specific ad performance, lead volume, or cost per lead. Advertising results vary based on market conditions, targeting, budget, and ad platform algorithms.
• You are responsible for ensuring your business holds all required licenses and permits to operate and advertise in your service area.

6. Lead and Applicant Data

• Leads and applicant submissions collected through your campaign landing pages belong to you (the agency).
• You agree to handle lead data in compliance with all applicable privacy laws and regulations.
• You will not use lead data for purposes unrelated to the services described in your campaign.
• CareAutopilot processes lead data on your behalf as a data processor. See our Privacy Policy for details.

7. AI-Generated Content

• Content generated by our AI tools (ad copy, social posts, blog articles, competitive analysis) is provided as a starting point. You are responsible for reviewing and approving all content before publishing or deploying it.
• AI-generated content may contain errors, inaccuracies, or suggestions that do not comply with your local regulations. Always verify content for accuracy and regulatory compliance.
• You retain ownership of AI-generated content created through your account.

8. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law or regulation.
• Submit false, misleading, or deceptive information in ad campaigns or landing pages.
• Attempt to access other users' accounts, data, or agency information.
• Interfere with or disrupt the Platform's infrastructure or security.
• Scrape, crawl, or automated-harvest data from the Platform without written permission.
• Use the Platform to collect data in violation of HIPAA, state privacy laws, or advertising platform policies.

9. Healthcare and Compliance Disclaimers

• CareAutopilot is a marketing platform, not a healthcare provider. We do not provide medical advice, care coordination, or clinical services.
• Agencies using our recruitment tools for Medicaid waiver program caregivers are solely responsible for verifying applicant credentials, certifications, background checks, and compliance with state waiver program requirements.
• Our platform does not collect, store, or process Protected Health Information (PHI) as defined by HIPAA.
• You are responsible for ensuring your advertising and hiring practices comply with the Fair Housing Act, Equal Employment Opportunity laws, and all applicable state and federal regulations.

10. Intellectual Property

The CareAutopilot platform, including its design, code, features, and branding, is owned by CareAutopilot. You are granted a limited, non-exclusive, non-transferable license to use the Platform for its intended purpose during your subscription.

11. Limitation of Liability

To the maximum extent permitted by law, CareAutopilot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, or business opportunities, arising from your use of the Platform.

Our total liability for any claim arising from your use of the Platform shall not exceed the amount you paid to CareAutopilot in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless CareAutopilot from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your advertising campaigns, your handling of lead data, or your violation of these Terms.

13. Termination

• You may close your account at any time by contacting support.
• We may suspend or terminate your account for violation of these Terms or for any activity that harms the Platform or other users.
• Upon termination, your access to the Platform ceases. We will retain your data for 90 days, after which it will be deleted unless required by law.

14. Changes to Terms

We may modify these Terms at any time. We will notify registered users of material changes via email or in-app notice. Continued use of the Platform after changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions.
